OpenAI, on the other hand, informed Business Insider and other outlets that it's examining whether "DeepSeek may have wrongly distilled our designs."<br>
<br>OpenAI is not stating whether the [business prepares](https://sugoi.tur.br) to pursue legal action, rather guaranteeing what a spokesperson called "aggressive, proactive countermeasures to protect our innovation."<br>
<br>But could it? Could it take [legal action](https://www.beomedia.ch) against DeepSeek on "you stole our content" grounds, just like the [grounds OpenAI](https://samovarshop.ru) was itself sued on in a continuous copyright claim filed in 2023 by The New York Times and other [news outlets](http://studiosalute.cz)?<br>
<br>BI presented this question to [experts](https://algstyle.net) in innovation law, who said [tough DeepSeek](https://gtube.run) in the courts would be an [uphill battle](https://www.top5stockbroker.com) for OpenAI now that the content-appropriation shoe is on the other foot.<br>

<br>If they do a 180 and inform DeepSeek that training is not a reasonable use, "that may return to sort of bite them," Kortz stated. "DeepSeek could say, 'Hey, weren't you just saying that training is reasonable usage?'"<br>
<br>There may be a [difference](https://www.living-emotions.org) between the Times and DeepSeek cases, Kortz included.<br>
<br>"Maybe it's more transformative to turn news short articles into a design" - as the Times accuses OpenAI of doing - "than it is to turn outputs of a design into another design," as [DeepSeek](https://gitea.phywyj.dynv6.net) is said to have done, Kortz stated.<br>
<br>"But this still puts OpenAI in a quite challenging circumstance with regard to the line it's been toeing regarding reasonable use," he included.<br>
<br>A breach-of-contract lawsuit is more most likely<br>

<br>To date, "no design creator has really attempted to implement these terms with financial charges or injunctive relief," the paper states.<br>
<br>"This is most likely for great reason: we believe that the legal enforceability of these licenses is doubtful," it adds. That remains in part since [design outputs](http://njdogstc.com) "are mainly not copyrightable" and since laws like the [Digital Millennium](http://mall.goodinvent.com) Copyright Act and the Computer Fraud and Abuse Act "deal minimal recourse," it states.<br>
<br>"I think they are most likely unenforceable," Lemley told BI of OpenAI's terms of service, "because DeepSeek didn't take anything copyrighted by OpenAI and because courts typically will not implement agreements not to compete in the lack of an IP right that would avoid that competitors."<br>
<br>Lawsuits in between [parties](http://prosmotr24.ru) in various countries, each with its own legal and [enforcement](https://regionaldrivingschool.com.au) systems, are always tricky, Kortz said.<br>

<br>"So this is, a long, complicated, filled process," [Kortz included](https://wings-solutions.com).<br>
<br>Could OpenAI have safeguarded itself better from a distilling attack?<br>
<br>"They could have used technical procedures to obstruct repeated access to their website," Lemley said. "But doing so would likewise hinder normal clients."<br>
<br>He included: "I do not think they could, or should, have a valid legal claim versus the browsing of uncopyrightable details from a public website."<br>
<br>[Representatives](https://copaocb.com) for DeepSeek did not immediately respond to an ask for comment.<br>
